In most of the U.S., an HOA can restrict some flags but cannot restrict others. What an HOA may regulate depends on federal law, state laws, and its own recorded rules.

 

Flags an HOA Cannot Ban

 

  • U.S. flag: Protected by the Federal Freedom to Display the American Flag Act. An HOA may set reasonable rules about size, placement, and mounting for safety and appearance, but it cannot forbid the flag itself.
  • State flags: Most states allow HOAs to regulate them, but a few states (for example, Texas) protect the right to display them similarly to the U.S. flag.
  • Military flags: Several states protect flags of military branches. If protected, the HOA may regulate only size, height, and mounting.

 

Flags an HOA Usually Can Restrict

 

  • Political flags: Many HOAs limit these because they tie them to signs. Some states require HOAs to allow them during election periods only.
  • Holiday or decorative flags: Often allowed but regulated by size, duration, or approved locations.
  • Cause‑based or organization flags: (sports teams, social movements). If not specifically protected by state law, the HOA can restrict them.

 

What “Reasonable Rules” Mean

 

Even when a flag is protected, an HOA may enforce rules for size limits, pole height, noise from flagpoles, attachment safety, and placement so it does not damage buildings or block views. These rules must apply evenly to everyone.

 

How to Know What Applies to You

 

  • Check your state laws: Some states expand flag protections or limit HOA power more than federal law.
  • Read your HOA’s CC&Rs and rules: If a rule conflicts with a state or federal protection, the higher law wins.
  • Look for amendment dates: Older rules may be unenforceable if laws changed later.

In short, HOAs cannot ban protected flags but may set reasonable appearance and safety rules. Flags not protected by law can generally be restricted under valid HOA rules.

  • State‑protected flags: Many states protect military flags, first responder flags, or state flags. HOAs cannot prohibit them but may still regulate location and size.
  • Other flags (political, seasonal, decorative): These may be restricted or even banned if the rule is in the recorded governing documents and applied evenly. HOAs often limit the number of flags or how long temporary flags may stay up.
  • Content‑neutral rules: Rules must focus on appearance, not message. For example, an HOA can limit all flags to a certain size but cannot allow some viewpoints and deny others.
  • Safety and structural limits: HOAs may restrict large poles, roof‑mounted hardware, or anything posing a hazard. These limits are generally valid if they do not target a specific flag type.

When a dispute arises, the key questions are: Is the flag type protected by law? Is the HOA rule reasonable, written, and applied to everyone the same way? If both answers support the homeowner, the restriction is usually unenforceable.
