When an HOA CAN Restrict Street Parking

 

  • Private streets: If the streets are owned or maintained by the HOA, the HOA may set and enforce parking rules. This can include time limits, guest rules, no‑overnight policies, or banning parking on one side for safety.
  • CC&Rs allow restrictions: The recorded community rules must include authority for parking control. If they do, the HOA can issue warnings, fines, and even tow (if state law allows).
  • Safety or fire lane rules: HOAs can enforce rules required by the fire department, such as keeping certain areas clear.

 

When an HOA CANNOT Restrict Street Parking

 

  • Public streets: If the city or county owns the road, the HOA normally cannot ban parking or ticket cars. Public roads fall under local traffic laws, not HOA rules.

Rules may limit long-term parking, block oversized vehicles, or require permits, as long as they are reasonable, uniformly enforced, and not discriminatory.

Public streets: Roads maintained by the city or county are controlled by local government. An HOA generally cannot ban or fine for parking on public streets unless the CC&Rs clearly create a homeowner obligation that does not conflict with public law. Most states do not allow an HOA to override traffic laws or impose HOA-only restrictions on government property.

  • HOA can regulate: Driveways, private lanes, guest lots, common areas.
  • HOA usually cannot regulate: Public streets, ADA-compliant parking rights, emergency vehicle access requirements.
  • City rules always win: Where HOA rules conflict with traffic law, local law controls.
